TERMS AND CONDITIONS OF SALE

These Terms and Conditions of Sale (“Terms”) govern the sale of products marketed under the French Vahine brand on the French Vahine website.

French Vahine is a brand operated by AURELO, a French limited liability company (SARL) with a share capital of €1,000, whose registered office is located at Appartement B62, 123 Quai Charles de Gaulle, 34280 La Grande-Motte, France, registered with the Montpellier Trade and Companies Register (RCS) under SIREN number 101 126 183, SIRET 101 126 183 00017.

1. Purpose and Scope

These Terms define the rights and obligations of AURELO and any individual acting for purposes outside their trade, business, craft or profession (“the Customer”) in connection with the online sale of French Vahine products.

Any order placed on the website implies acceptance of these Terms in the version applicable at the time the order is placed.

2. Products

French Vahine offers jewellery made in particular with cultured Tahitian pearls, stainless steel and, depending on the creation, gold-filled components.

The essential characteristics of each product are presented on its product page.

Photographs and descriptions are prepared with the greatest care. However, colours and reflections may vary depending on the screen used.

As Tahitian pearls are natural materials, each pearl is unique. Variations in shape, diameter, colour, lustre or surface may therefore exist between the jewellery received and the photographs shown on the website. These natural characteristics contribute to the uniqueness of each creation.

Products are offered subject to availability or, where specified on the product page, made to order.

3. Prices

Prices are indicated in euros, inclusive of all applicable taxes (VAT included), excluding any delivery charges.

Applicable delivery charges are shown to the Customer before final confirmation of the order.

French Vahine reserves the right to change its prices at any time. However, products will be invoiced at the price displayed when the Customer confirms the order.

For deliveries outside the European Union or to certain territories, customs duties, taxes or other charges may be payable at destination. Where applicable, these are the responsibility of the Customer unless otherwise stated.

4. Orders

The Customer selects the products they wish to order and adds them to their basket.

Before confirming the order, the Customer may review its contents and total price and correct any errors.

The order becomes final once the basket has been confirmed, these Terms have been accepted and payment has been made.

An order confirmation email summarising the order will be sent to the Customer.

AURELO reserves the right to refuse or cancel an order for legitimate reasons, including fraud or attempted fraud, payment incidents or disputes relating to payment for a previous order.

5. Payment

Payment is due when the order is placed.

The available payment methods are those offered on the website at the time of ordering.

Payments are processed using the secure payment solutions available on the website. French Vahine does not retain the Customer’s complete bank card details.

6. Delivery

Products are delivered to the address provided by the Customer when placing the order.

Jewellery in stock is prepared for dispatch within 2 to 5 business days. Some creations may be made to order and may therefore require additional production time; where applicable, this is specified on the product page.

Available delivery methods and their rates are presented to the Customer during checkout. Depending on the destination, these may include tracked letter services, tracked Colissimo or delivery to a collection point.

A tracking number is provided to the Customer when the selected shipping method includes tracking.

The applicable delivery date or estimated delivery time is communicated to the Customer before the order is concluded, in accordance with applicable law.

The Customer must check that the address provided when placing the order is accurate.

Upon receipt, the Customer is advised to check the condition of the parcel and products and to contact French Vahine as soon as possible in the event of any issue.

7. Right of Withdrawal

In accordance with the French Consumer Code, consumer Customers have 14 days from receipt of the goods to inform French Vahine of their decision to withdraw, without having to provide a reason.

The Customer may exercise this right using the withdrawal form provided at the end of these Terms or by making any other unambiguous statement expressing their decision to withdraw.

The Customer must then return the product no later than 14 days after communicating their decision to withdraw.

Direct return shipping costs are the responsibility of the Customer.

The Customer is responsible for any diminished value of the product resulting from handling beyond what is necessary to establish its nature, characteristics and proper functioning.

8. Exceptions to the Right of Withdrawal

In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply, in particular, to goods made to the consumer’s specifications or clearly personalised.

This exception may apply in particular to French Vahine creations made or personalised specifically according to the Customer’s individual choices, where the legal requirements for the exception are met.

9. Refunds Following Withdrawal

In the event of a valid withdrawal, AURELO will refund the amounts due to the Customer, including the initial delivery costs within the limits provided by applicable regulations, no later than 14 days from the date on which AURELO is informed of the Customer’s decision to withdraw.

AURELO may withhold the refund until the product has been returned or until the Customer provides evidence that it has been shipped, whichever occurs first.

The refund will be made using the same payment method as that used for the original transaction, unless the Customer expressly agrees to another method and provided that this does not result in any fees for the Customer.

Products sold benefit from the statutory guarantee of conformity and the statutory guarantee against hidden defects under the conditions provided by applicable law.

Information relating to statutory guarantees

The consumer has a period of two years from delivery of the goods to invoke the statutory guarantee of conformity in the event of a lack of conformity. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date on which it arose.

Where the contract for the sale of goods provides for the continuous supply of digital content or a digital service for a period exceeding two years, the statutory guarantee applies to such digital content or digital service throughout the agreed supply period. During this period, the consumer is only required to establish the existence of the lack of conformity affecting the digital content or digital service and not the date on which it arose.

Where applicable, the statutory guarantee of conformity requires the professional to provide all updates necessary to maintain the conformity of the goods.

The statutory guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of their request, free of charge and without significant inconvenience.

Where goods are repaired under the statutory guarantee of conformity, the consumer benefits from a six-month extension of the original guarantee.

Where the consumer requests repair of the goods but the seller requires replacement, the statutory guarantee of conformity is renewed for a period of two years from the date of replacement.

The consumer may obtain a reduction in the purchase price while retaining the goods, or terminate the contract and receive a full refund in exchange for returning the goods, where:

  1. The professional refuses to repair or replace the goods;
  2. Repair or replacement takes place more than thirty days after the request;
  3. Repair or replacement causes significant inconvenience to the consumer, in particular where the consumer permanently bears the cost of taking back or removing the non-conforming goods, or the cost of installing repaired or replacement goods;
  4. The lack of conformity persists despite an unsuccessful attempt by the seller to bring the goods into conformity.

The consumer is also entitled to a price reduction or termination of the contract where the lack of conformity is sufficiently serious to justify an immediate price reduction or termination. In such circumstances, the consumer is not required to request repair or replacement beforehand.

The consumer is not entitled to terminate the sale where the lack of conformity is minor.

Any period during which the goods are unavailable for repair or replacement suspends the remaining guarantee period until the repaired or replacement goods are delivered.

The rights referred to above arise from the application of Articles L.217-1 to L.217-32 of the French Consumer Code.

A seller who, in bad faith, obstructs the implementation of the statutory guarantee of conformity may be subject to a civil fine of up to €300,000, which may be increased to 10% of average annual turnover (Article L.241-5 of the French Consumer Code).

The consumer also benefits from the statutory guarantee against hidden defects pursuant to Articles 1641 to 1649 of the French Civil Code, for a period of two years from discovery of the defect. This guarantee entitles the consumer to a reduction in price if the goods are retained or to a full refund if the goods are returned.

French Vahine endeavours to respond to enquiries as quickly as possible.

12. Liability

AURELO is responsible for the proper performance of its contractual obligations under the conditions provided by applicable law.

However, AURELO shall not be held liable where failure to perform or improper performance of the contract is attributable to the Customer, to an unforeseeable and unavoidable act of a third party to the contract, or to an event of force majeure.

The Customer must follow the instructions for use and care of the jewellery provided by French Vahine.

13. Intellectual Property

The French Vahine brand, as well as the texts, photographs, videos, illustrations, logos, graphic elements and, more generally, the content available on the website are protected by applicable intellectual property rights.

Any unauthorised reproduction, representation, exploitation or use of these elements is prohibited within the limits provided by law.

14. Personal Data

Personal data collected when an order is placed is processed in accordance with the Privacy Policy available on the website.

15. Consumer Mediation

In the event of a dispute, the Customer is invited to contact French Vahine first in order to seek an amicable solution.

In accordance with the provisions of the French Consumer Code relating to consumer dispute mediation, after contacting French Vahine and in the absence of a satisfactory response, the consumer Customer may use, free of charge, the consumer mediation service provided by:

16. Applicable Law and Dispute Resolution

These Terms are governed by French law.

In the event of a dispute, an amicable solution will be sought as a priority.

If no amicable agreement can be reached, the consumer Customer may bring proceedings before the competent court in accordance with the applicable rules of ordinary law.
